1. Acceptance of Terms
By accessing or using StartApps ("Service"), operated by Entesta Web Solutions Pvt Ltd ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these terms, you must not access or use the Service.
These Terms apply to all visitors, users, and customers who access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Service Description
StartApps provides an automated lead capture chatbot service for businesses. Our service includes:
- Custom Chatbot Setup: We configure a branded conversational chatbot tailored to your business services, pricing, and frequently asked questions.
- Website Widget Integration: A lightweight chat widget is embedded on your website to engage visitors 24/7.
- Lead Capture & Routing: The chatbot captures visitor information and routes qualified leads to your calendar for appointment booking.
- Lead Dashboard: An online dashboard where you can view all captured leads, conversations, and booking activity.
- Ongoing Maintenance: Hosting, uptime monitoring, conversation flow updates, and technical support.
3. Account Registration
When you complete the checkout process, we create an account on your behalf using the email address you provide. You are responsible for:
- Providing accurate and complete business information during registration
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Payment Terms
4.1 Setup Fee
A one-time setup fee of $499 USD is charged at the time of checkout. This fee covers the initial chatbot configuration, brand calibration, and website integration. Payment is processed securely through our payment partner, Dodo Payments.
4.2 Monthly Subscription
A recurring subscription of $49 USD per month is charged automatically starting from the date of purchase. This subscription covers ongoing hosting, maintenance, support, and dashboard access.
4.3 Cancellation
You may cancel your subscription at any time by contacting our support team. Upon cancellation, your chatbot will remain active until the end of the current billing cycle. No further charges will be applied. Please refer to our Refund Policy for details on refund eligibility.
4.4 Currency & Taxes
All prices are quoted in US Dollars (USD). Applicable taxes (including GST for Indian customers) will be calculated and applied at checkout where required by law.
5. Intellectual Property
5.1 Our Property
The Service, including but not limited to the software, website design, text, graphics, logos, and underlying technology, is the property of Entesta Web Solutions Pvt Ltd and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
5.2 Your Content
You retain ownership of all business information, service descriptions, and branding materials you provide to us for chatbot configuration. By providing this content, you grant us a non-exclusive, worldwide license to use it solely for the purpose of delivering the Service to you.
6. Acceptable Use
You agree not to use the Service to:
- Engage in any unlawful, fraudulent, or deceptive activity
- Transmit spam, phishing messages, or misleading information through the chatbot
- Collect personal data from visitors in violation of applicable privacy laws
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to our systems or networks
- Use the Service in a manner that violates any applicable local, state, national, or international law
Violation of these terms may result in immediate suspension or termination of your account without a refund.
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.
We do not share your proprietary business data across other clients. Each customer's chatbot configuration and lead data is completely isolated.
8. Service Availability & Uptime
We strive for 99.9% uptime for all hosted chatbots. However, we do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or force majeure events may cause temporary downtime. We will make reasonable efforts to notify you in advance of planned maintenance.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Entesta Web Solutions Pvt Ltd shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Damages resulting from unauthorized access to or alteration of your data
- Damages arising from third-party services, integrations, or APIs
Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Entesta Web Solutions Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
- Your chatbot will be deactivated immediately
- Your lead data will be available for export for 30 days
- After 30 days, all associated data may be permanently deleted
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
Before initiating any formal legal proceedings, you agree to first attempt to resolve the dispute through good-faith negotiations by contacting us at support@startapps.in.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
